Privacy Policy
Effective date: 12 June 2025
Who we are
Layvr ("we", "us", "our") is a digital agency providing web design, brand design, creative content, and social media management services. Our contact email is hellolayvr@gmail.com.
We are committed to protecting your personal information and being transparent about what we collect and why. This policy applies to information we collect when you use our website or contact us about our services.
What information we collect
We collect information you provide directly to us when you:
- Submit an enquiry via our contact form (name, business name, email address, phone number, message)
- Email or call us directly
- Engage us for services and enter into a client agreement
We may also collect limited technical information automatically when you visit our website, such as your IP address, browser type, and pages visited, via analytics tools.
How we use your information
We use the information we collect to:
- Respond to your enquiries and provide quotes for our services
- Deliver the services you have engaged us to provide
- Send invoices and manage payments
- Communicate updates relevant to ongoing work
- Improve our website and understand how visitors use it
- Comply with our legal and regulatory obligations
We will never sell your personal data to third parties, and we will not use your information to send unsolicited marketing emails without your prior consent.
Our lawful basis for processing
Under the UK General Data Protection Regulation (UK GDPR), our lawful bases for processing your personal data are:
- Legitimate interests — when responding to enquiries and considering whether to enter a business relationship
- Contract performance — when processing data necessary to deliver agreed services
- Legal obligation — when we are required to retain financial records or comply with other laws
- Consent — where you have opted in to any marketing communications
How long we keep your data
We retain enquiry data for up to 12 months after last contact if no contract is entered into. Client data (including project files, invoices, and correspondence) is retained for a minimum of 6 years following the end of the client relationship, in line with HMRC requirements for financial records. After these periods, data is securely deleted.
Who we share your data with
We may share limited data with trusted third-party service providers who help us run our business, including:
- Netlify — our website hosting and form collection provider (USA, operating under standard contractual clauses)
- Email providers — to send and receive communications
- Payment processors — to handle invoices and payments securely
All third parties are contractually required to handle your data securely and only for the purposes we specify.
Your rights
Under UK GDPR, you have the right to:
- Access the personal data we hold about you
- Correct any inaccurate or incomplete data
- Request deletion of your data ("right to be forgotten")
- Restrict or object to how we process your data
- Receive your data in a portable format
- Withdraw consent at any time where consent is the basis for processing
To exercise any of these rights, please contact us at hellolayvr@gmail.com. We will respond within 30 days.
Complaints
If you believe we have not handled your data appropriately, you have the right to lodge a complaint with the UK's Information Commissioner's Office (ICO) at ico.org.uk or by calling 0303 123 1113.
Changes to this policy
We may update this privacy policy from time to time. We will post the updated version on this page with a revised "last updated" date. Continued use of our website after any changes constitutes acceptance of the updated policy.
Terms & Conditions
Effective date: 12 June 2025
Agreement
These Terms & Conditions ("Terms") govern the relationship between Layvr ("we", "us", "our") and any client or visitor ("you") who engages our services or uses our website. By engaging our services, you agree to be bound by these Terms.
Services
Layvr provides digital services including, but not limited to:
- Website design and development
- Brand and logo design
- Static image and creative content production
- Social media management and content scheduling
The specific scope, deliverables, timeline, and price for any engagement will be agreed in writing (via email or a formal proposal) before work commences. No work begins until agreement is confirmed in writing.
Pricing and payment
Our standard service prices are as follows:
- Website Build — £499 one-off fee, payable upon project commencement
- Monthly Upkeep — £100 per month, required with all active website builds, billed monthly
- Creative Content — £300 per month for up to 20 static image creations
- Social Media Management — from £250 per month, with the exact fee depending on agreed post volume
Invoices are payable within 14 days of the invoice date unless otherwise agreed. We reserve the right to pause work on any project where payment becomes overdue beyond 14 days.
Late payment: Overdue invoices may be subject to statutory interest under the Late Payment of Commercial Debts (Interest) Act 1998, at 8% above the Bank of England base rate.
Monthly retainer services
Monthly services (upkeep, creative content, social media management) continue on a rolling monthly basis until either party provides written notice to cancel. A minimum of 30 days' written notice is required to end any monthly retainer. Notice must be sent to hellolayvr@gmail.com.
Monthly fees are non-refundable once the billing period has commenced. If you cancel a retainer mid-month, service continues until the end of the current paid period.
Client responsibilities
To allow us to deliver work to the agreed standard and timeline, you agree to:
- Provide all required content, materials, and approvals in a timely manner
- Ensure that any content you supply does not infringe third-party intellectual property rights
- Designate a primary point of contact for feedback and approvals
- Respond to requests for feedback or approval within a reasonable timeframe (typically 5 business days)
Delays caused by failure to provide materials or approvals may result in revised timelines and, where significant, additional costs.
Intellectual property
Upon receipt of full payment for a project, all intellectual property rights in the custom deliverables created for you (including website designs, logos, and graphics) transfer to you.
Layvr retains the right to display completed work in our portfolio and use it for promotional purposes, unless you expressly request otherwise in writing.
Any third-party assets used in your project (such as licensed stock images, fonts, or plugins) remain subject to their respective licence terms. You are responsible for maintaining any ongoing licence fees for such assets after delivery.
Revisions and scope changes
Our standard packages include a reasonable number of revisions within the agreed scope. Material changes to project scope, or revision requests beyond what is reasonably included, may be quoted and charged separately. We will always seek your approval before proceeding with any out-of-scope work.
Limitation of liability
Layvr provides services with reasonable skill and care. However, to the maximum extent permitted by law, our total liability for any claim arising from or related to our services is limited to the total fees paid by you for the specific service giving rise to the claim in the 3 months preceding the claim.
We are not liable for any indirect, special, incidental, or consequential loss, including loss of profit, loss of revenue, or loss of data, even if advised of the possibility of such loss.
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded.
Confidentiality
Both parties agree to keep confidential any sensitive business information shared during the course of an engagement and not to disclose such information to third parties without prior written consent, unless required by law.
Termination
Either party may terminate a project or retainer by providing written notice as specified in the relevant service section above. Where Layvr terminates a project for reasons other than the client's breach, we will refund any fees paid for work not yet delivered.
We reserve the right to terminate any agreement immediately where the client acts in bad faith, engages in abusive conduct, or fails to remedy a material breach within 7 days of written notice.
Governing law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Entire agreement
These Terms, together with any written proposal or project agreement, constitute the entire agreement between you and Layvr regarding the services, and supersede all prior discussions, representations, or agreements.
